Regulating Workplace Safety System and Sanctions by Neil Gunningham, published by Oxford University Press in 1999, spans 423 pages and is presented in English. This book explores how law can influence the internal self-regulation of organizations to enhance their responsiveness to occupational health and safety concerns. Drawing from international experiences and recent developments in regulatory theory, it examines the potential of occupational health and safety management systems to foster self-organization within firms, encouraging them to reflect critically on their safety performance.

Readers will find a detailed analysis of a two-track regulatory system, offering enterprises a choice between traditional regulatory methods and a safety management system-based approach. The book also discusses the role of criminal and administrative sanctions in motivating organizations to implement effective occupational health and safety management systems. By integrating insights from comparative law and labor and employment practices, this edition provides a comprehensive examination of regulatory frameworks and their implications for workplace safety.

Official synopsis Publisher

Drawing from international experience, on recent developments in regulatory theory, and upon models and approaches constructed during the author’s empirical research, this book addresses the question: how can law influence the internal self-regulation of organizations in order to make them more responsive to occupational health and safety concerns? In this context, it is argued that occupational health and safety management systems have the potential to stimulate models of self-organization within firms in such a way as to make them self-reflective and to encourage informal self-critical reflection about their occupational health and safety performance. This book argues for a two-track system of regulation under which enterprises are offered a choice between a continuation of traditional forms of regulation and the adoption of a safety management system-based approach on the other. The book concludes with a discussion of the use of criminal and administrative sanctions to provide organizations with incentives to adopt effective occupational health and safety management systems.
